CLAUDIO VITULLO

Barrister & Solicitor

T 416.745.0362 e-mail: cvl@vitullolaw.com

Claudio has been practising employment and labour law on behalf of employees since 1994, first with a boutique firm based in Mississauga, and later on his own in the city of Toronto. He has worked in all areas of employment and labour law, with a particular focus on wrongful dismissal actions, labour disputes, certification and decertification of unions, civil and labour litigation, and employee relations. Claudio also has provided services to OECTA (Ontario English Catholic Teachers Association as a panel member on the grievance committee), and remains an active Union member to date.

Among numerous others, Claudio has represented employees alleging various sorts of discrimination and harassment, well in  advance of current popular trends, leading to their wrongful dismissal. He regularly appears before adjudicative tribunals, including the OLRB, the HRTO, the WSIAT, the Federal Court of Canada, the Ontario Superior Court of Justice, and the Court of Appeal for Ontario.  Claudio has extensive experience challenging large national and international employers, in particular American and western European corporations, who tend to have a very different way of conducting business which impacts on their differing legal approach. He is fluent in both official languages, is prepared to do trials in both English and French, and has completed courses in the French Civil Law of Quebec.

Although representing primarily employees, some of Claudio’s clients are mid-sized local employers who rely on him as an extension of their human resources department. Claudio’s objective is to spare employers from having to pay expensive legal judgments leveled at them later . He considers his work a form of education for employers. Business decisions are not always legal ones-it is best employers discover this harsh , but equitable, reality  in consultation, and not at trial.

Claudio is adept at explaining the law in a comprehensible way, and taught grade 12 law for a number of years with the TCDSB, and has done considerable Pro Bono work in Toronto, and was also a student interning in the Workers’ Rights Division of Parkdale Community & Legal Services, in Toronto.
